中醫藥相關研究成果之可專利評估暨專利申請

在知識經濟的今天，無形的智慧資產遠遠已經超越有形資產的重要性，而從科學和技術的角度來看，專利則是無形的智慧資產中最有影響力，在生物醫藥領域甚至還強調：沒有專利的人根本就不是player。很可惜的是在台灣，專利相關的教育沒有普及，再加上對於研究成果之評估也多著重於論文之發表，使得原本有些很好的研究成果只發表在期刊論，因而喪失有價值的產出。有鑑於此，本計畫擬針對案針對行政院衛生署中醫藥委員會所補助中醫藥研究成果，進行可專利性評估，期望能從而將研究成果最有價值化。而作法上會先針對每一件研究成果作可專利性檢索，評估其可專利性中之新穎性與非顯而易知性，隨後再召開專家評估會議，邀請專家指導評估和篩選出有價值的申請案，從而撰寫專利說明和到價值潛力之地區提出專利申請。而過程之中，除了透過專利資料庫檢索和分析之外，本計畫亦將會與原計畫執行者聯繫，畢竟研究人員還是最懂得其成果，這將有助於可專利性和價值之評估；再則是可從而普及專利相關的觀念，對於從事研究的人員亦能夠從而獲益。

Patentability and patent application for those research funded by Committee on Chinese Medicine and Pharmacy

It is said that if you do not have patents you are not a player in the bio related technology. In other words, without the protection of patent, the govement conferring the right to exclude others from making, selling, offering for sale or using an invention for the term of the patent, the result of a research would be valueless. Therefore, it is very necessary to do the patentability search as well as evaluation for those projects funded. We propose to evaluate the patentability of those botanic related researches funded by Committee on Chinese Medicine and Pharmacy, Department of Health, Executive Yuan. To reach the goal, we will do patentability search, evaluate the novelty and unobviousness requirement for each each research and have an expert counsulting meeting to confirm those results to be patented. Following, we will work closely with the researchers and patent attorneys to prepare the patent application documents. Furthermore, we also hope to progress the research model with patent concept to the currently proceeding researches.
