中醫藥相關研究成果之可專利評估暨專利申請(2-2)

在知識經濟的今天，無形的智慧資產遠遠已經超越有形資產的重要性，而從科學和技術的角度來看，專利則是無形的智慧資產中最有影響力，在生物醫藥領域甚至還強調：沒有專利的人根本就不是player。很可惜的是在台灣，專利相關的教育沒有普及，再加上對於研究成果之評估也多著重於論文之發表，使得原本有些很好的研究成果只發表在期刊論，因而喪失有價值的產出。

有鑑於此，本計畫擬針對案針對行政院衛生署中醫藥委員會所補助中醫藥研究成果，進行可專利性評估，期望從而能將研究成果最有價值化。而第一年度的執行中發現有許多學研界的先進沒有優良研發規範的觀念，以至於因為已發表、未作先前技藝檢索等，而使得研發的成果沒有可專利性，使得原本可能價值連城的研發成果，喪失產出經濟價值的機會。

因而本年度的計畫把重點放在推廣教育上，預計舉辦兩場研討會來推廣優良研發的觀念，另外則還會繼續作研發成果的可專利性篩選，若有合適的成果亦會提出一件專利申請案會。相信從研討會的舉辦來普及專利相關的觀念，對於從事研究的人員應當能夠從而獲益。

The patentability evaluation and patent prosecution for the botanical drug related research(2-2)

It is said that if you do not have patents you are not a player in the bio related technology. In other words, without the protection of patent, the govement conferring the right to exclude others from making,selling, offering for sale or using an invention for the term of the patent, the result of a research would be valueless. Therefore, it is very necessary to do the patentability search as well as evaluation for those projects funded.

During the first year project, we have evaluated 42 research results funded by Committee on Chinese Medicine and Pharmacy, Department of Health, Executive Yuan. However, all of them do not meet the patentability criterion due to the reasons such as already been published, without prior search search. Following, we will focus on the education seminars this year.

This year, we will schedule at least two seminars to educate researchers the concept of Good Researcg and Development Practice (GR&DP). The seminar will basically cover the concept of GR&DP, the patent protection for Chinese medicine related research, patentability, and patent search.Hopefully, the project can benefit to the researchers.
